New Mandatory ISO Inland Marine Cyber Incident Exclusion Endorsements and Updated Inland Marine Coverage Forms Discussions in CPI
This release to Commercial Property Insurance
(CPI) provides updated discussions of the inland marine coverage
forms in the Insurance Services Office, Inc. (ISO), and American
Association of Insurance Services (AAIS) filed inland marine programs.
Beginning in August 2021 in a majority of jurisdictions, ISO inland marine
program rules require the attachment of a cyber incident exclusion endorsement
to all filed inland marine policies. There are two options: either the Cyber
Incident Exclusion (CM
99 08) endorsement or the Cyber Incident Exclusion with Ensuing Cause(s) of
Loss Exceptions (CM
99 09) endorsement.
- The Cyber Incident Exclusion (CM 99 08) endorsement contains an exception that preserves
coverage for fire or explosion loss that results from a cyber incident.
- The Cyber Incident Exclusion with Ensuing Cause(s) of Loss Exceptions
(CM 99 09) endorsement contains the same exception
preserving coverage for fire or explosion loss and also preserves coverage
for ensuing loss from other causes, subject to the limits of insurance
shown in the endorsement schedule.
This release updates these three discussions to reflect the new requirement
in the ISO filed inland marine insurance program—effective in August 2021 in
most jurisdictions—to attach one of two cyber incident exclusion endorsements
to all policies.
