New Cases Added, Pollutants List Updated, and More in Pollution Coverage Issues

The following improvements have been made in this release of Pollution Coverage Issues (PCI).

Eight cases were added to "CGL Issue 5—Allocation," "CGL Issue 6—'Sudden and Accidental' Exception," and "CGL Issue 8—Absolute Pollution Exclusion" sections.

Cases dealing with the following substances have been added to the list of substances courts have considered whether or not to be "pollutants."

PDFs of these decisions have been added to the Caselaw Library, which now contains 5,745 cases.

In this edition of IRMI's Environmental Insurance Reporter, Research Analyst Lisa Smuckler, J.D., ERIS, CRIS, discusses Recyc Sys. Se., LLC v. Farmland Mut. Ins. Co., 2018 U.S. Dist. LEXIS 82248 (M.D. Ga. May 16, 2018), a case in which the US District Court for the Middle District of Georgia became the latest court to apply the absolute pollution exclusion to bar coverage for claims alleging property damage caused by noxious odors.
