Five New Cases Added to Pollution Coverage Issues in July 2017


This Pollution Coverage Issues release adds five new cases to various sections of this reference. PDFs of these cases have been added to the Caselaw Library, which now contains 5,252 PDFs of cases. In this edition of IRMI's Environmental Insurance Reporter, Research Analyst Lisa Smuckler, J.D., CRIS, discusses the U.S. Court of Appeals for the Second Circuit's recent decision in Cincinnati Ins. Co. v. Roy's Plumbing, Inc., 2017 U.S. App. LEXIS 9729 (2d Cir. May 31, 2017). The Roy's Plumbing case confirms that sewage is a pollutant under New York law but also illustrates how the factors New York courts use to limit application of the absolute pollution exclusion might broaden its application and could lead to some surprising results for nonindustrial policyholders.
