The law is intended to overturn the US Supreme Court's ruling in Ledbetter v. Goodyear Tire & Rubber Co., 550 U.S. 618, 127 S. Ct. 2162, 167 L. Ed. 982 (2007), in which the court held that the statute of limitations for presenting an equal pay lawsuit begins to run on the date on which the initial discriminatory pay level was agreed, not on the date of the most recent paycheck, as a lower court had ruled. The Act was intended to clarify the intent of Title VII as it pertains to discriminatory pay decisions. Accordingly, the new statute enables female workers to litigate allegedly discriminatory pay decisions that were made many years in the past, irrespective of the requirement that a claim be filed within 180 days of a discriminatory act.
