False Arrest

Definition

The act of detaining a person unlawfully on groundless accusations that the person has committed a crime. While charges of false arrest can be brought against governmental law enforcement officers, it is more commonly a tort committed by private security personnel or others charged with protecting the property of their employer or members of the public while on the employer's premises. False arrest is a personal injury (PI) offense insurable under general liability and other forms of liability insurance.
