Statutes of Repose Summaries Revised in Construction Risk Management


Statutes of repose limit the amount of time that contractors can be held liable for damages resulting from defective construction. Although the vast majority of states have construction industry repose statutes, the limitation periods range from 4 to 15 years. Moreover, the scope of what is covered and whom the statute protects varies by state. Furthermore, state courts and legislatures have imposed various limitations or exceptions to the statute—in at least one case, decades after the statute of repose had expired.
