State Law Workers Compensation Summaries Updated in IRMI Workers Comp


This release of IRMI Workers Comp updates the state law workers compensation act summaries for all 51 jurisdictions to reflect the changes made by the 2017 legislative sessions. (Note that California and Colorado have some changes that are not effective until July 1, 2018. These state summaries will be again updated in advance of those changes.) State legislative sessions were quite active in 2017. Some of the common legislative initiatives included defining the parameters of attorney fees, refining injuries not covered, and quantifying what constitutes an independent contractor. What comprises a compensable mental injury was also a significant legislative topic. Colorado and Maine made refinements to their Acts while Vermont implemented a statute addressing this issue for the first time. The most popular legislative trend in 2017 focused on quantifying coverage for first responders. Arizona, Missouri, Montana, Nebraska, New Hampshire, New York, North Carolina, Texas, Vermont, and West Virginia enacted legislation aimed at honing coverage and benefits for this type of employment.
