Endorsement CG 21 44 Revision Explained in Commercial Liability Insurance


In an expanded annotation of standard commercial general liability endorsement CG 21 44, this Commercial Liability Insurance release explains the judicial background behind a recent revision of the endorsement to restrict coverage to injury or damage that occurs on the premises designated in the endorsement. The earlier edition of this endorsement covered liability arising from "operations necessary or incidental to" the designated premises, and that language was often broadly interpreted by courts to apply to injury or damage occurring off premises, as long as a direct connection to the business conducted on the premises could be demonstrated. That scope of coverage is no longer provided by CG 21 44.
