Court Case Addresses Coverage for Third-Party-Over Actions in Contractual Risk Transfer

This release of Contractual Risk Transfer contains a discussion of a North Dakota appellate court that has become the latest to address the problem of establishing coverage for third-party-over actions in the absence of any allegations against the named insured employer. The court interpreted a standard additional insured endorsement, triggering coverage only when injury or damage is caused at least in part by an act or omission of the named insured, to apply in certain cases even when workers compensation laws preclude asserting any causal involvement to the (named insured) employer.
