Alabama Federal Court Ruling on Sewage Discussed in Pollution Coverage Issues


This Pollution Coverage Issues release adds five new cases to various sections of this reference. PDFs of these cases have been added to the Caselaw Library, which now contains 4,776 PDFs of cases. In this edition of IRMI's Environmental Insurance Reporter, Research Analyst Lisa Smuckler, J.D., CRIS, discusses a recent decision by the U.S. District Court for the Middle District of Alabama, Evanston Ins. Co. v. J&J Cable Constr., LLC, 2016 U.S. Dist. LEXIS 129371 (M.D. Ala. Sept. 22, 2016). In Evanston Ins. Co., the court relied on two previous Alabama Supreme Court cases to reach a decision that sewage was not a "pollutant" under the absolute pollution exclusion.
