UM/UIM and No-Fault Coverage Updates in Commercial Auto Insurance


This Commercial Auto Insurance updates Arkansas UM/UIM provisions to conform to the ruling in Cross v. State Farm Mut. Auto. Ins. Co., 2018 Ark. App. 98 (2018). Endorsement changes are effective November 2018 that remove the governmental-owned vehicle exception previously found in the definition of "insured/underinsured motor vehicle."

There were also updates to UM/UIM endorsement forms in the states of Montana, New York, Oklahoma, and Utah and the territory of Puerto Rico.

As well, the UM/UIM state pages navigation map has been color-coded to highlight states that do require signed forms on renewal policies or at some other time after the initial policy inception.

Effective January 23, 2018, New York Financial Services has finalized regulation 11 NYCCR 68 (Insurance Regulation 83) regarding healthcare service fees for services provided outside the state of New York for reimbursement under New York no-fault insurance.
