The March 2007 issue of The Risk Report examines the risk manager's role before, during, and after litigation and trial occur. Written by Kevin Quinley, it describes many areas where the risk manager needs to be involved, including coordinating with general counsel, supervising cost management, considering settlement options, avoiding surprises, and keeping management apprised, among others.

The March 2007 issue of Captive Insurance Company Reports (CICR) includes the following articles:

Reference Manuals

Commercial Auto Insurance addresses the entire spectrum of ISO multistate commercial auto endorsements, including 21 revised endorsements and 4 that were newly introduced in 2006. This supplement also updates state-specific information on a variety of topics (i.e., synopses of state-specific amendatory endorsement provisions, cancellation endorsement provisions, and a listing of applicable endorsements and current edition dates of each).

Commercial Liability Insurance updates the discussion of GCL Coverage A exclusions, adding new information to section V.D on the exclusions that pertain to expected or intended injury; property damage to owned, rented, or occupied property; and aircraft, autos, and watercraft. Additions to section V.J explain how a federal appellate court has been called upon to give effect to a fairly recent revision of the CGL "other insurance" condition--the provision that makes the policy's coverage excess over other insurance the named insured may have as an additional insured under another policy. This supplement also contains new discussions of commercial umbrella endorsements in section XI, including a section describing the three mandatory umbrella endorsements, discussion of groups of umbrella endorsements treating certain loss exposures (condominiums, terrorism, and construction risks), a brief discussion of the application of state UM/UIM laws to commercial lines umbrellas, and several points to keep in mind when assessing the steps that need to be taken to keep umbrella placements in compliance.

Construction Risk Management updates the workers compensation laws section and portions of the general liability insurance section. The Construction Risk Management Newsletterpresents an article illustrating how the construction and insurance industries have adapted in response to the construction defect litigation explosion of the past decade.

D&O MAPS has been expanded to include the following policies and analyses:

Personal Risk Management and Insurance updates the annotated discussion of the homeowners insurance policy's insuring agreement and definitions section with expanded analysis and the addition of over 65 pertinent caselaw citations. In particular, more comprehensive discussions of various defined terms such as "bodily injury," "business," "insured," "occurrence," and "property damage" are included. The supplement also provides an extensive analysis about properly insuring home-based businesses. In addition, it updates several UM/UIM (Florida, Louisiana, Oregon, South Carolina, and Virginia) and no-fault state (Florida, Michigan, and Minnesota) pages.
