The August issue of
The Risk Report, "Top
10 D&O and E&O Claim Battlegrounds," identifies 10 areas that frequently
become contentious in D&O and E&O claims, and discusses some of the nuances
of the issues that arise in connection with each. Suggestions for avoiding the
problems are provided.
The August issue of the
Captive Insurance Company Reports
begins with "Emerging
Trend: Owners Switching Managers," which presents statistics on how many
captives being managed by the largest captive managers are being lost through
mergers and acquisitions, captive liquidation, poor service, and staff turnover.
"Banks' Improving Health
Will Lead Recovery," by captive investment adviser Al Heeg, comments on
the state of the economy and offers thoughts for captives and their investments.
Bermuda's recent captive
conference is also reviewed.

Commercial Liability
Insurance updates the changes made in the multistate endorsement
revision that became effective in May of this year, including the introduction
of a broader exclusion for
illegal recording and distribution of materials or information (CG 00 68),
a
limited exclusion for operations covered by a wrap-up (CG 21 31) that provides
coverage when a wrap-up policy terminates, and a
communicable disease exclusion endorsement (CG 21 32). The supplement also
revises additional insured endorsements pertaining to governmental agencies
or subdivisions in connection with
permits to conduct certain work or activities (CG 20 12) or
permits or authorizations relating to premises (CG 20 13),
underground resources and equipment coverage (CG 22 62), and the
waiver of subrogation endorsement (CG 24 04).
D&O MAPS
has been expanded to include the following policies and analyses.
IRMI Workers Comp
updates material pertaining to
small and
large deductibles;
payroll
limitations for sole proprietors, partners, and executive officers; and
limited liability company members and state-specific
experience
rating modifier premium qualification thresholds. Additionally included
in the supplement is a new discussion that examines the increased claim costs

and SCHIP Extension Act Also incorporated in this supplement are updated state
law and state workers compensation benefit summaries.
Professional Liability
Insurance features a revision of the
accountants professional liability insurance coverage discussion (section
XIII.E). Since this section was last updated, the policies written to cover
accountants have undergone significant changes. This supplement also contains
the annual update of the Professional Liability
Insurance market directories, encompassing revisions of both the overall
market directory found in section V, as well as the
individual, profession-specific directories included throughout the entire
manual. In addition, the
Topical Index
is also updated in this supplement.
