Newsletters & Journals
In the
January issue of
The Risk Report, "Tactics for Arranging
Business Income Coverage," Chris Boggs offers guidance for answering important
questions: What does the business income worksheet reveal? How is the proper
coinsurance percentage chosen and are there other options? How can laws and
regulations affect BI coverage?
"Insurance Outlook: 2008" leads the January issue of
Captive Insurance Company
Reports (CICR), summarizing the predictions of Robert Hartwig
of the III. Dennis Mahoney of Aon Global looks at
capital markets, and Russell Busst of Credit Agricole Asset Management explains
why
captives are not immune to the liquidity crunch. Notes from the
World Captive Forum and the
DC Captive Conference round out the issue.
Reference Manuals
CGL Reporter
adds over 95 new annotations of recent insurance-related cases from appellate
courts around the nation. Two new articles—one on
recouping defense costs and the other on the
Illinois "Kotechi Waiver"—are included. A new edition of
CGL Reporter Bulletin and
updated indexes
and tables of cases are also included.
Commercial Auto Insurance
is devoted almost exclusively to state-specific updates throughout the manual.
These include revisions in
uninsured/underinsured motorists
coverage in 12 states,
no-fault coverage in
15 states, and state forms
and rules variations in 9 states. The supplement also brings the state
cancellation endorsement provisions up-to-date and includes a complete listing
of all
state-specific endorsements, including edition dates.
Commercial Property
Insurance features a new discussion of
analyzing multiple causation and adds a
table of cases
to the manual. It also continues the expansion of the ISO annotated forms section
of the manual, adding relevant caselaw and related commentary on the
exclusions and
resumption of operations provisions in the business income and extra expense
coverage form (CP 00 30) and on the causes of loss provisions in the
basic and broad causes of loss forms (CP 10 10 and CP 10 20). Updated
checklists for several lines of coverage are included as well.
Construction Risk
Management provides an updated discussion of
conditional
payment clauses, including a
summary of states' positions on such clauses and relevant case citations,
an updated discussion of
commercial auto insurance, and the 2007 construction insurance market report.
Numerous other updates that reflect changes in laws and/or standard policy and
contract forms are also included. The
Construction Risk Management Newsletter provides updates on construction
and insurance industry developments.
Contractual Risk
Transfer features an expansion of the
state construction anti-indemnity chart. The chart adds a new column that
addresses whether and how the state anti-indemnity statutes apply to contractual
requirements to provide insurance for another. Also, this supplement expands
the discussion of how to draft indemnity provisions to comment on specific provisions
addressing such issues as
allocation of defense, reimbursement of defense costs, selection of counsel,
and consent to settle. The discussion of additional insured status under
general liability policies is expanded to add caselaw relevant to the
CGL "damage to your work" exclusion exclusion and explains the extent to
which courts will infer an intent on the part of contracting parties to require
or provide insured status when such an intent is not clearly stated in the contract.
D&O MAPS
has been expanded to include the following policies and analyses.
Personal Risk Management
and Insurance brings new information on high-value homeowners
insurance.
Section
14.I introduces the concept of homeowners insurance for the affluent. Sections
14.J and
14.K compare the "high value" offerings of Fireman’s Fund and Chubb with
the standard HO 5 from Insurance Services Office, Inc. (ISO).
Section
14.S is an expanded discussion of the AAIS policy. A new article in
section
5.L compares the SPAP with the PAP. The piece on ISO Personal Auto Policy
Eligibility requirements in
section 8.C is also updated. In addition, this supplement includes an update
of
homeowners and
PAP cancellation requirements. Finally, it updates several states'
UM and
no-fault pages.
