CAN-SPAM Act
The Controlling the Assault of Non-Solicited Pornography and Marketing Act
of 2003. A federal law regulating the use of unsolicited emails for marketing
purposes. Such emails are generally prohibited by the Act unless they contain
correct header information, a physical address for the mailer, and an opt-out
mechanism for recipients. Legal liability in connection with CAN-SPAM violations
is ordinarily excluded under general liability policies.
