CGL Issues and Developments
General liability insurance is a key aspect of any contractor’s risk management
program. The CGL policy provides coverage for the potentially devastating risks
associated with contractual liability, construction defects, and a host of other
types of losses. Despite the importance of this coverage, it presents some of
the most complex and least understood coverage issues for most contractors and
their insurance representatives. This session provides a high level technical
review of four key coverage areas—allocation of defense and indemnity, additional
insured issues, the impaired property exclusion (arguably the least understood
aspect of CGL coverage), and coverage for construction defects—and brings participants
up to speed on recent legal developments affecting them. Attendees will leave
this session with a better understanding of their rights to defense and indemnity,
what coverage they are giving (or getting) through additional insured endorsements,
recent developments in the complex construction defect arena, and when coverage
applies to impaired property claims.
